Terms Of Service

The provider of "Pitch Page" is "lookto UG (haftungsbeschränkt)", represented by the managing directors Mr. Sumanth Haußmann and Mrs. Angela Stöver, Jenckelweg 19, 26367 Hassendorf.

The aim of "Pitch Page" is to create an international hub to improve the networking of offers, demands and requests between different actors. This includes offers of help, commercial and private offers.

With "Pitch Page" contacts between interested parties, initiators and projects can be established and immediate interactions and campaigns can be initiated.

"Pitch Page" thus forms a platform that offers greater connectivity and communication between supporters and projects, between private individuals as well as traders and potential buyers. "Pitch Page" offers its services based on the following terms of use:

§ 1 Definitions

Provider in the sense of these General Terms of Use is "lookto UG (haftungsbeschränkt)". User is any natural and/or legal person who, based on a contract with the Provider, uses the service "Pitch Page" provided by the Provider in order to offer its products and/or services to third parties.

Third party is any natural or legal person who uses the service "Pitch Page" provided by the provider to negotiate and/or conclude contracts with users about products and/or services.

§ 2 Scope of Application

The following General Terms of Use apply to the use of the "Pitch Page" service and the use of the services offered with it, thus to all contractual relationships between the User and the Provider via the "Pitch Page" service.

The Provider provides its services exclusively on the basis of these General Terms of Use. The Terms of Use that are available online on the Provider's website at the respective time (specific use by the User) shall apply in each case.

By using the Pitch Page service, the User declares his full agreement with these General Terms of Use. The User's own General Terms of Use/General Terms and Conditions of Business shall not apply even if the User reserves the right to use the "Pitch Page" service on the condition that only its General Terms of Use shall apply.

These General Terms and Conditions of Use do not apply to the contractual relationships between the respective users with third parties. The respective user is free to introduce his own General Terms and Conditions into the contractual relations between users among third parties.

§ 3 Scope of use

The user undertakes not to offer any pornographic, politically extremist, religiously fanatical or other content that is not in accordance with the free democratic basic order of the Federal Republic of Germany or Europe or otherwise violates applicable law via the "Pitch Page" service.

The user undertakes not to engage in any unsolicited communication with third parties within the scope of the "Pitch Page" service. The user is aware that he may be exposed to claims for injunctive relief or damages by third parties in the event of a violation of this.

§ 4 Scope of services

The services of the provider are limited solely to the provision of the platform, the enabling of connectivity and communication between users and third parties as well as the provision of the "Pitch Pages" with the possibilities of further dialogue and possible contract conclusions. The services of the provider explicitly do not extend to the conclusion of contractual relationships, in particular also not to contracts between users and third parties. No purchase, service or other contracts for the acquisition of the products or services presented on "Pitch Pages" are concluded with "Pitch Page". Contracts for the purchase of the products or services presented on the websites are established exclusively between the customer and the respective users.

§ 5 Liability

The provider does not guarantee that a contract will actually be concluded via the service of "Pitch Page". Likewise, "Pitch Page" does not guarantee that contract negotiations via the service of "Pitch Page" will be successful and that the goal and the hoped-for benefit of the users will be realized.

The provider assumes no liability for content provided by users or third parties on the platform, in particular not for the content of offers and/or negotiations.

The provider assumes no liability for incorrect operation, incorrect input or incorrect information in offers made by users or third parties on the platform. The provider assumes no liability for damages and/or data loss resulting from the use of insecure passwords by users or third parties.

The provider assumes no liability for technical problems. This also includes the temporary inaccessibility of the Pitch Pages or/and or the temporary unusability of the platform for technical reasons. This does not apply to intentional or grossly negligent actions of the provider.

The provider assumes no liability for damages caused by the use of third party services (especially payment providers) by users or third parties.

The provider assumes no warranty for faulty advertisements of the pitch page with third parties and no guarantee that third parties will meet their payment obligations to users.

§ 6 Services subject to payment

Registration with the Provider is free of charge.

Upon initial registration, the User will be provided with free "Pitch Pages" by the Provider in order to test the Provider's range of services. The use of the "Pitch Pages" provided free of charge does not oblige the User to purchase further "Pitch Pages".

The purchase of further "Services" is subject to a charge. All prices and costs are net. In addition to these net prices, the User shall pay the statutory value added tax applicable at the time of purchase, currently in the amount of 19%, on the respective purchase price. Payments have to be made without deduction exclusively in cash via the means of payment named during the purchase process.

The Provider reserves the right to make price adjustments for the future and/or to supplement, expand and/or completely change the price structure at any time within the scope of operational necessities.

The Provider is entitled to carry out promotions for all or individual Users that deviate from the aforementioned pricing structure. At the same time, the Provider is entitled to individualize prices with individual and/or several Users and to negotiate prices individually according to need and request. These individually negotiated or individualized prices may differ from the aforementioned pricing.

Neither the implementation of promotions, nor individualized pricing with individual/multiple users shall give rise to a legal claim for other users to be granted the same or other individual prices or to set up individual price structures.

§ 7 Recommendations

The Provider reserves the right to offer benefits to individual or multiple Users for recommending the Provider's services. The benefits offered are binding, but the one-time offer of benefits does not grant a legal claim for the future to the granting of one or more benefits.

The decision whether and under which conditions a benefit is offered and how the benefit is designed or in which way it is made available is the sole responsibility of the Provider

§ 8 Jurisdiction

The place of jurisdiction for all disputes arising from the underlying contractual relationship is Germany. This is to the exclusion of the Hague Uniform Laws on the International Sale of Goods and the German conflict of laws. The exclusive place of performance and jurisdiction is the registered office of the supplier.

§ 9 Severability clause

Should individual provisions of these General Terms and Conditions of Use be or become void or ineffective in whole or in part, this shall not affect the validity of the remaining provisions. The law shall take the place of any General Terms and Conditions that are not included or are invalid. In all other respects, the parties undertake to replace the void or invalid provision with a valid provision that comes as close as possible to the intended provision in economic terms, insofar as no supplementary interpretation of the contract is possible as a matter of priority. Although this also applies to gaps that arise or become known in the context of the applicability of the general terms of use.
